Terms of Service
The contract between you and Cualify.
1. Acceptance
By creating a Cualify account, you agree to these Terms, the Privacy Policy, the Acceptable Use Policy, and the Data Processing Agreement (collectively, the Agreement).
2. Services
Cualify provides AI calling services (outbound + inbound voice agents), client portal, billing, notifications, and integrations. The exact features available to you are determined by your plan.
3. Subscriptions and credits
Plans renew monthly or annually. Included voice minutes do not roll over. Credit-pack purchases are valid for 12 months. Cancellation takes effect at the end of the current billing period; unused credits remain valid.
4. Compliance
You represent that every contact list you upload is collected lawfully and that you possess valid consent for outbound calling under TRAI TCCCPR 2018 and DPDP Act 2023. We reserve the right to suspend campaigns that violate the Acceptable Use Policy or applicable law.
5. Liability
Our aggregate liability under this Agreement is limited to fees paid by you in the 12 months preceding the event giving rise to the claim. We are not liable for indirect, consequential, or special damages.
6. Governing law
This Agreement is governed by the laws of India. Disputes are subject to the exclusive jurisdiction of courts in Bengaluru.
7. Changes
We may update these Terms with 30 days' email notice. Material changes that affect your rights will be highlighted. Continued use after the effective date constitutes acceptance.
